PhotoAwake is a web application that transforms user-uploaded photos into animated videos with background music. The Service uses artificial intelligence to animate static images and combines them into a cohesive video presentation.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:

- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4. Credits and Payments
PhotoAwake operates on a credit-based system. Credits are purchased through our payment processor (Stripe) and are used to generate animated videos.
5. Acceptable Use
You agree NOT to upload or use content that:
- Contains nudity, sexually explicit material, or pornography
- Depicts violence, gore, or harmful activities
- Infringes on intellectual property rights of others
- Contains hate speech, harassment, or discriminatory content
- Violates any applicable laws or regulations
- Contains malware or malicious code
All uploaded content is automatically screened by AI moderation. Content that violates these guidelines will be rejected and may result in account suspension.
6. Intellectual Property
Your Content
You retain all ownership rights to photos you upload. By using the Service, you grant us a limited license to process, transform, and store your content solely for the purpose of providing the Service.
Generated Videos
Videos generated by the Service are owned by you. You may use, share, and distribute your generated videos for personal and commercial purposes.
Music Usage
Background music provided in the Service is licensed for use within generated videos only. You may not extract, distribute, or use the music separately from generated videos.
7. Privacy
Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED VIDEOS WILL MEET YOUR EXPECTATIONS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTOAWAKE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
10. Changes to Terms
We may update these Terms from time to time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.
